Fresh Meadows REI Management provides efficient and compliant eviction services for single-family and multi-family operators in the Bexar County, Texas area. We focus on managing the eviction process professionally and concisely, ensuring all state and federal regulations, including applicable provisions of the CARES Act, are met.
Our streamlined process minimizes legal risk and time-to-resolution by managing every step of the eviction process:
- Documentation and notification: We prepare and issue all required notices to vacate with strict adherence to Texas Property Code and other applicable laws.
- Court filing and appearances: Our team prepares and files all necessary eviction paperwork with the appropriate Bexar County Justice of the Peace court.
- Court hearings: We provide competent representation for all eviction hearings, presenting all evidence to secure a favorable judgment.
- Post-judgment procedures: We manage the five-day appeal period and, if needed, coordinate with the constable for the legal execution of a Writ of Possession.
Adherence to the CARES Act
Though passed during the COVID-19 pandemic, certain notice provisions of the CARES Act are permanent for specific properties. Our process includes a mandatory verification step to determine if a property is "covered" and, if so, to issue the federally required 30-day notice to vacate.
Covered properties include:
- Properties with federally-backed mortgages (e.g., Fannie Mae and Freddie Mac).
- Housing participating in federal programs (e.g., Section 8).
Compliance with Texas and Bexar County law
- Minimum 5-day notice: We provide a minimum of a 5-day notice to vacate for most evictions, including those for non-payment of rent, as required by the Texas Property Code and reinforced by Texas SB 38 (2025).
- Mandatory statewide rules: As of 2025, statewide rules supersede any local city or county eviction ordinances. We stay current with state legislation, such as SB 38, to ensure full compliance.
- No "self-help" evictions: We strictly follow legal procedures and avoid illegal "self-help" evictions, such as changing locks or cutting utilities, which are prohibited under Texas law.
Our systematic approach
- Consultation and review: We review the client's case and lease agreement to establish legal grounds for eviction.
- Property verification: We check government databases to verify whether the property is subject to CARES Act notice requirements.
- Notice to Vacate: We issue the proper notice (5-day or 30-day, depending on property status), delivered via certified mail and certificate of mailing, as permitted by Texas law.
- Eviction filing: After the notice period, we file a Petition for Eviction with the correct Bexar County precinct court.
- Representation and judgment: We attend court on behalf of the client to present the case and obtain a judgment.
- Writ of Possession: Once a judgment is secured, we work with the constable to obtain and enforce the final Writ of Possession.
